GENERAL TERMS AND CONDITIONS OF SALE

1. General provisions
We reserve the right to refuse service/sale to anyone for any reason at any time.
These Terms of Sale apply to all contractual relations between the end Buyer and Ampus Atelier*.
Buyer using the website www. ampus-watch.com (the "Site"), agrees to comply with these terms and conditions, as well as the general terms and Privacy Policy.

2. Applicability
The Buyer confirms that he has read these Terms of Sale and accepts them in full as an integral part of the Agreement with Ampus Atelier, without reservations, changes or restrictions.
These Terms of Sale are subject to change at the sole discretion of Ampus Atelier, which will be published on the website www. ampus-watch.com. Any order placed after the publication of the new version of the general terms of sale by Ampus Atelier implies their acceptance. The terms of sale must be accepted during the order process and must form an integral part of the purchase and sale agreement.

3. Price and payment conditions
1) Prices for goods with a delivery address in the Russian Federation are indicated in Russian rubles. Prices must be valid at the time of order.
2) Prices for goods with a delivery address outside the Russian Federation are paid in euros excluding VAT. Prices must be valid at the time of order.
Please note that in case of delivery outside the Russian Federation, additional fees may be charged, including local VAT and customs clearance fees. The bank may also charge an additional fee for the payment. All these additional fees are borne solely by the Buyer.

4. Product order
When placing an order, the Buyer undertakes to purchase the selected products in accordance with these Terms of Sale.
The sale is considered completed only when the following conditions are met:
1. Ampus Atelier has sent you an e-mail confirming that it is ready to start production or that products are available for sale;
2. Ampus Atelier has sent you an email confirming receipt of funds from the Buyer in the amount of 100% prepayment.
Confirmation is sent by email ampus.watch@gmail.com for each order. Prior to Ampus' written confirmation, orders placed on the Internet do not imply acceptance of your order as a purchase and sale agreement.
If the product is out of stock, the Buyer will be informed immediately.
Payment for an order made by e-mail is made immediately on the day of the order. The price can be settled online using a credit card (Visa, Mastercard, MIR, International Maestro and American Express) by e-mail sent by Ampus Atelier to the Buyer or by bank transfer.
Any order is considered to be a firm and binding agreement on the conclusion of a purchase and sale agreement as soon as Ampus Atelier receives your order and sends a personal confirmation of the order from its Email.
We reserve the right, at our sole discretion, to reject or cancel any order placed with us.

5. Delivery
All orders accepted by Ampus Atelier are sent to the delivery address specified by the Buyer. In any case, the risk passes to the Buyer after the transfer of the goods to the carrier or forwarder. Delivery of goods is carried out by DHL (except the Iran and Ukraine).
The fee for the delivery of new products ordered by the Buyer at the Ampus Atelier is paid by the Ampus Atelier.
All other transportation costs (in particular, refund after warranty service or simple maintenance) are borne by the Customer. The shipping cost may vary depending on the country of delivery. If necessary, you can contact us to get an estimate of the shipping cost for your country.
The buyer is always responsible for the delivery costs of the returned goods (especially in the case of exercising the right to refuse), unless otherwise specified by Ampus Atelier in writing.

6. Warranty
Your watch is covered by a warranty for a period of  2 year (24 months) from the date of purchase in accordance with the terms of this warranty.
The warranty covers material and manufacturing defects existing at the time of delivery of the watch. Upon receipt, the buyer must check the goods to exclude obvious defects, as well as damage during delivery or transportation.
The dial may contain small bubbles, minor irregularities, roughness, small inclusions. This is not a manufacturing defect, but the natural behavior of vitreous enamel in the manufacture of the dial.
Leather watch straps and leather inner linings can leave colored traces when moisture or sweat gets on the skin. They are harmless and will disappear when rinsed with water. We cannot guarantee that stains on clothing (for example, a leather strap rubbing against a shirt) can be removed, and we are not responsible for this. These possible traces are not a sign of poor quality of the bracelet, but are characteristic of a natural product.
The warranty does not apply:
— normal wear and aging (for example, scratched glass; change in color and/or material of non-metallic straps and chains, such as leather, textiles, rubber);
— any damage to any part of the watch as a result of improper/negligent use, carelessness, negligence, accidents (bumps, dents, crushing, broken glass, etc.), improper use of the watch;
— indirect damage of any kind caused, for example, as a result of the use, inactivity, defects or inaccuracy of the watch;
— for water damage when using the watch in an environment that does not correspond to the waterproof class;
— malfunctions due to the magnetization of the clock mechanism;
— watches that were handled by unauthorized persons (for example, for maintenance or repair) or that were changed in their original condition without the control of Ampus Atelier. Thus, watches opened, modified, processed or repaired by unauthorized third parties are no longer covered by the warranty.
The aforementioned warranty does not affect the Buyer’s rights with respect to the seller or any other binding legal rights that the Buyer may have with respect to the Seller.
Without limiting the scope of these Terms of Use, no request for delivered goods or services, non-delivery of goods or services or otherwise shall exceed the amount of the purchase price of goods or services that served as the basis for the claim for damages.
Any other claims against Ampus Atelier, for example, damages in addition to the warranty described above, are expressly excluded, with the exception of mandatory legal rights that the Buyer may have in relation to the Manufacturer.

7. Return of the goods
The Buyer has 14 days from the date of delivery to exercise his right to refuse and return the goods, provided that he has previously informed Ampus Atelier by e-mail. Excluded from the scope of the right of refusal are goods manufactured to the consumer’s specifications or uniquely personalized, non-standard or unique products made to the Buyer’s individual requirements, as well as goods sold at a discount.
For any refusal, Ampus Atelier withholds 15% of the sale amount to cover the costs incurred for shipping, transaction and payment of taxes.
Before any return, you must contact Ampus Atelier in advance (ampus.watch@gmail.com). Unless expressly agreed otherwise, shipping costs and possible financial fees are borne by the Customer. The goods must be returned by the Buyer at his own expense to the Ampus Atelier no later than fourteen days after he informed the Ampus Atelier of his decision to refuse.
All returned items must be received in their new unused condition, fully equipped and in their original packaging.
The refund may be suspended until Ampus Atelier receives the goods.
Damaged, incomplete or damaged items handed over by the Buyer are not accepted back (since they cannot be resold) and, accordingly, are not refundable.

8. Data privacy
The Parties undertake to comply with the confidentiality provisions. They take all regulatory, administrative, technical and organizational measures necessary to ensure that the information and data exchanged in the context of the performance of the contract are not accessible to unauthorized third parties.
Personal data is processed only in the strict context of the performance of the contract. In addition, they can also be transferred to trading partners or companies, provided that this is necessary for the performance of the contract, and subject to confidentiality provisions.
